Title: Beer & Cigarettes - Legal to Resell?

Just a hypothetical, but let's say you came across a unit full of beer or cigarettes. Could you legally resell them? From the research I've done, it's my opinion that you can legally trade it as a commodity but you might run into some problems if you try to sell it for cash. Anyone have a different opinion or know the laws pertaining to this in their state?

As long as they have a legal tax stamp on them you can sell them.

Uh, where I live that's a negatory. You can "gift" them though.

Of course different states, different laws.
If this happened to me, I would probably visit independent combo gas stations / tobacco outlets and see what could be worked out.
Since I'm not a smoker, I don't know how age and storage conditions would affect cigarettes.

I think you could sell them to individuals as opposed to large retailers. Usually large retailers need to pay a certain tax amount to become a reseller so if you were to simply sell them without the tax portion, then you might be charged on that aspect. It is better to be safe than sorry especially if the profits that you are looking to reel in are not that high and not worth the possible risks.

I totally agree. Discretion is key. The reason I started this thread is because  :67: "someone I know" came across 45 +/- cases of premium beer in a climate controlled unit. Appears to be overflow from a bar. The person who bought said unit has "traded" about 25 of the cases so far and he just met an individual who drinks a case a day, so the remaining cases should be gone in the next 3 weeks.
