Title: Illegal to Own? Illegal to Sell?
Post by: Travis on May 28, 2013, 09:36:02 PM
I have heard that it is illegal to resell government issued body armor and gas masks. Just wondering if anyone has come across items like this and what the laws are pertaining to them.

I'm pretty sure Texas covers vests the same as pistols.
Must be 21, can't be felon.....

Other than that its legal to buy/sell/own/wear.

Not since I outgrew my childhood fantasy of being a commando/sniper/ninja...so last week.  ;D

No, it's been about 25 years since I've been in a Army surplus store.

Google 'First Sale Doctrine'....

Everything you legally obtained you can legally sell.

NO trademark owner, manufacturer etc can prohibit you from reselling used or even new items, as long as they were legally obtained.

Of course the limits are, if it is stolen property. If you legally buy a locker and it turns out to be stolen stuff you can't sell it.
Same applies to otherwise outlawed items, illegal guns etc.

OR if you agreed in writing to not resell something.

This always pisses me off.   Buy locker, stolen goods, I'm in possession of stolen goods.
Cops take, THEY auction off.....oh, it's all cool now.
