Title: Are Online Storage Auctions Legal in the State of New York?
Post by: Travis on October 22, 2014, 05:22:51 PM
Sam asked:

Hi Travis. I asked you several weeks ago if online storage auctions were legal in the state of Vermont. You were very helpful and informative. I'd now like to know if they are legal in the state of New York. Any information you could provide would be greatly appreciated. Thank you.

Sam, once again, I am not an attorney and this should not be construed as legal advice.

After reviewing New York lien laws, it is my opinion that it's perfectly legal to have an online storage auction in New York.

According to § 182. 7.  An owner's lien may be enforced by public or private sale of the goods that have been removed from the storage space at a self-service storage facility, in block, or in parcel, at any time or place and on any terms which are commercially reasonable after notice to all persons known to claim an interest in the goods.

Since online storage auctions are arguably more commercially reasonable than an in-person sale, they seem to comply with the law.
